Some of these answers are actually incorrect. To clarify, you do NOT forfeit your right to privacy in public. While it is certainly more diminished than it would be in a place like a private residence or event, there is some expectation of privacy.

Also, if someone is under 18, the guy pornography angle is potentially an issue, but it isn't necessarily that cut and dry.

Basically it depends on what your friend is doing with the pictures. If he is posting them anywhere in a public forum, i.e. a blog or facebook, he is liable for the photos, even if there is no nudity. If he is simply keeping them on his phone or for private "use", it is unlikely that law enforcement would take action (unless there were pictures of minors and they could prove his sexual intent).

Any time you take someone's picture without their consent, you need to be prepared to suffer consequences from it. If you are on private property, even in Wal Mart, there are probably policies in place that prohibit taking pictures of patrons, so tell you friend to really be careful about his actions. If the store does have a policy like that, they can take legal action if they catch your friend.
