What should I tell him, I'm very concerned. | Some of these answers are actually incorrect. To clarify, you do NOT forfeit your right to privacy in public. While it is certainly more diminished than it would be in a place like a private residence or event, there is some expectation of privacy.
Also, if someone is under 18, the guy pornography angle is potentially an issue, but it isn't necessarily that cut and dry.
Basically it depends on what your friend is doing with the pictures. If he is posting them anywhere in a public forum, i.e. a blog or facebook, he is liable for the photos, even if there is no nudity. If he is simply keeping them on his phone or for private "use", it is unlikely that law enforcement would take action (unless there were pictures of minors and they could prove his sexual intent).
Any time you take someone's picture without their consent, you need to be prepared to suffer consequences from it. If you are on private property, even in Wal Mart, there are probably policies in place that prohibit taking pictures of patrons, so tell you friend to really be careful about his actions. If the store does have a policy like that, they can take legal action if they catch your friend.
Try googling "fourth amendment rights" to look at your specific situation. I found a good website for specific legislation regarding privacy rights: www.fourthamendmentsummaries.com.

Wow.....I really started somethin didn't I, looks like all the vultures are waiting on the branches to fly down and devour this writer for asking a simple question...." What is the definition of guy porn."
Now, I am a single Father of 68 and I am Against ANY form of guy abuse period.! All I wanted to ask was what do other intelligent folk feel
about a current very controversial and neccessary subject which is affecting people from all walks of life Worldwide and that is guy porn.
And for some unknown strange reason I get violated and receive a tumultuos vortex of reprimanding replies as if I was a proponent advocating it.! Gimme a break people......I was just emphasising the fact that some over zealous cops, prosecutors and judges were making mountains out of molehills. There has to be differentiation between some fantasies and actual crime commitance surely., or have we reached the thought police stage.? My question related to whether someone videoing young females underwear in public places or taking upskirt shots, etc should be considered as serious guy porn offenses as compared with really explicit guy sexual activity, etc.
I saw and still see no reason why intelligent folk cannot simply analyze and discuss this like adults, especially as iut is occuring all around us daily evreywhere.Wow, some people even resorted to criticising my grammar and spelling errors. SOOOOORRRRY, even I make human mistakes.! I reiterate again, I don't believe what I pointed out constitues real, explicit guy porn and there is no evidence of victimization. I must have also provoked the self righteous moralistic hypocrites among us and those who have nothing better to do than sneer, jibe and ridicule all intelligent and timely questions, but I thank and appreciate those folk who understood what I was getting at and responded accordingly.
Journalist,
Writer, Director,
Radio and televison personality | I don't believe there is a "definition" as such. It seems to be left up to the interpretation of the lowest, just graduated, -wants to make a name for themself- cop on the beat.
I have known and heard of parents being prosecuted for having family snaps of their guyren who just happened to be playing in a paddling pool naked.
The law is an ***, and once someone or something gets in to the system, common sense flies out of the window.
Saying that, there is definitely a difference between collecting pictures and actively abusing; I believe that the two offenses should be treated differently and separately. |
